I was arrested for shoplifting in CA. I was an adult at the time. It was my first offense. I stole $450 worth of merchandise. The Store Name LP said because I had scissors and they had evidence that I cut the sensors off the clothes, that it could be a felony. She was also trying to get me to say that I had the intent to steal when I step foot in the store, which is burglary and could be another felony. They took me to the PD, and let me go after an hour or so. My court date is scheduled for Sep. I have to pay Store Name $325, which seems odd to me, because I stole more than that. My biggest concern now is that will they take me to jail?? I'm willing to pay my $1,000 bail, community service, anything, besides go to jail. I'll be attending college full time in the fall, andI would hate to have to serve time. They say jail for first time offenses is rare, but I'm not so sure about my case, because of the evidence they have of me using the scissors, and they might use burglary against me, and I let it slip to the arresting officer after he read my Miranda Rights, that I have done it a few times before. I should have just kept my mouth shut!!! PLEASE HELP ME!!

You need a Lawyer this is felony on at least two issues

A. The value of what you stole exceeded $400.00

B. You used a tool

Intent can be shown because yu had tool but that falls into B

Jail is a very real possibilty the option of Diversion is gone I will assume meaning you "will" have a criminal record

Yes that would be smart thing to do. Your have a real chance at jail so you need some legal help. It might also help to enrol in an Anti Shoplifting course. If Judge sees you have done this ahead of court he will surely smile upon your efforts.

If they do decide to send me to jail, can't I just pay the bail and not have to go? I figure that would be cheaper than a lawyer. I will still ask for a PD, but I could still go to jail.

You dont barter in court thats done as part of plea bargain. It would be very dumb to pursue anything without a Lawyer

Bail is not "get out of jail for $$" Bail is money they hold so you show up for court.
If you get sentenced to jail, you go to jail.
