Ok I'm going to run this down the shortest least dramatic version possible. Ok so around 3 years ago I brought my truck in for a basic head gasket shop at a shop in Texas that will remain undisclosed for now. After the truck was there a couple of weeks the man who owned the shop asked if I would be interested in a race truck sponsorship. I informed the man that I used the truck for a daily driver and raced in occasionally. After a while I decided to let him sponsor me for one race in FL. Long story short the truck was never finished and we didn't make it to florida. So we short wheel based the truck and did the head work.

The shop owner told me after failing to make the Florida race. that we would finish building the truck that spring. That never happened either. Now after I have been to the shop I noticed my block is damaged beyond repair my transmission is gone and I keep noticing things that have gone missing off the truck. I did not buy this truck to cannibalize it.

After I confronted the shop owner he informed me that I owed him $17000+ I told him no way I'd pay that due to this never being discussed or signed off on or for that matter even an invoice sent other than the original head job invoice of 3500 that I already have paid in full. The truck is sitting in pieces with less that 50k on the odometer. The truck was 35000 new and I either want the truck or my money.

I just wanted to get some other folks guidelines on what should be done here. I have never in my life had to seek legal advice and don't know where to even start or if I have a chance. I just want to make this right. since the truck has been down I have had to buy a second truck to keep from having to borrow on all the time. The truck went into the shop September 30 2010 and was running ,but had a blown head gasket now it doesn't run or have some of the hard parts it came with. Any help appreciated.

You will need a lawyer.
The mechanic can place a mechanic's lien on your truck if you refuse to pay.
This appears to be getting very complicated.
I suggest you discuss it with 2 or 3 local attorneys in your county.
The initial consultations are often offered free of charge.
A lawyer can sometimes write a letter to the other party and get some compromise or movement to avoid court action.
At any rate, see what the local lawyers suggest.
This ain't going to be pretty or easy, as mama used to say.

One can see several compelling arguments on the shop owners side. Storage, abandonment, violation of a sponsorship agreement. You do not have a $35k truck. You did not have one when you took it in there. You had a truck with blown head gasket and possibly several other issues.
