I recently sold an Xbox360 for $175 through craigslist, I had it listed for $250 but accepted the $175 because I needed the money. We met at a McDonalds and I handed him the the box with everything listed and he handed me the money and we were on our way.
I made sure everything was working and I never had any issues with it and gave him my word that everything was there and working properly.
4 days later he emails me about the original warranty and the I replied to him no warranty is included and was not listed. He replies about a seal being tampered with for the included Hard drive. I admitted to him I broke the seal but I did not tamper with the unit itself and told him exactly why it was broken as I had planned on opening it to increase the memory but never got around to buying it.
He then replies stating if he knew the unit had been tampered with then he would not have bought it. He said he has my home # and the license plate and he can find out where I live.
I reply again telling him it was not tampered with, told him why the seal was broken.. again. Then I told him if he is going to threaten me I will not reply to anymore emails and further contacting me will result in legal action. ( I consider it harassment).
He replies again stating his father is an attorney and he is going to file for a small claims case against me.
My question is, what should I do? Because I didn't state the seal was broke he can sue over it? He knew it was opened and used and everything does work as described and I answered any of his questions before he bought it. The seal is useless to him and does not in no way hinder the the operation of the Xbox360, it's just there for warranty purposes which he could not get anyway because he is not the original purchaser.
