Surfing on the internet I found out that my landlord/broker had published photos of my bedroom and living room online without my consent. I was not aware of pictures being taken during their showings (which I cordially agree to) let alone the fact that they were online for anyone to see. Felt exposed and demanded them to be taken down. Do I have a case?

Depends on what you mean by a "case." Should they take them down, Sure. Can you force them to, I doubt it. You allowed them to come into your home to "show" it. By doing so I would imagine you gave up your right to privacy in the respect that they took pictures. You didn't tell them not to. Is there something embarrassing about them? Or are you just the intensely private type that feels violated?

Would you rather have the landlord bringing people over on a regular basis to show the apartment and having strangers marching all around the house?
I really don't think you have anything to be complaining about here.
The landlord is allowed to show the property.

There's nothing embarassing about the pictures, just the fact that they were posted online w/o my consent and I didn't like to see my stuff online. They were taken down upon my request, but I am upset. They have pictures of the apartment w/o furniture, which they'd been using for months, it was completely unnecessary to upload more pictures. Thanks for taking the time to share your thoughts. best regards

I am assuming that the purpose of the pictures was to show the property for sale. If so, then I don't see the harm in it. Perhaps they wanted to show the room furnished for a particular reason, or maybe the unfurnished pictures were very old... Your consent was not needed to put the pictures on the Internet though.

The other option, as said, is to have strangers wandering through the house to see it in person.

If the pictures were taken down at your request then there is really nothing else to do.

I understand the problem. The key is to decide what you want to do.

1) You probably have some right to have the pictures taken down. You can always use the DMCA to file a complaint and have the pictures taken down immediately under the claim of pictures of private, personal property.

2) With regard to compensation, if that's what you're after it would be negligible, IMHO, unless there are some very personal, identifiable items you don't want listed.

3) If you really don't care about the "violation" and it's more about the point, you can tell your landlord and decide what it is you really want.
