Posting Mug Shots Online

Need some advice, I run a website called wcmugs dot com we post mug shots of people in our community that has been arrested at one time or another, but we do not post any info on the person just their name, our community is a pop. of around 5,000 and we get around 15,000 hits a month and we are going state wide and was wandering if there are any laws we need to be aware of after all information on our site is public record.
 
I don't know all the details in particular and state laws. They very well could be different per state. If you are using public information then you shouldn't have a problem in theory. Many others do this (for example, the New York Newsday posts pictures of those arrested for DUI / DWI which are also public record.) The Tribune also posts pictures throughout its network of newspapers (I've seen it in the New York Daily News) where mug shots of famous people are posted. My concern would be in California, where there are more privacy laws issues but usually public records are just what they are. Have you checked on whether there are any usage rights from your sources?
