Our Home is on an R-1 lot backing up to the parking lot of a business. Thirty-five (35) years ago I asked the owner if I could install a gate on my property to allow ingress and egress for my 16 foot trailerable boat across their property. It would ,also, provide a half mile short cut to the bank that I used which was 200 feet from the proposed gate. Happily, she said, "Yes". I offered to pay her yearly for the right but was told that was unnecessary. I placed the gate two feet on my side of the common property line just in case there was a change of heart in the next few years - I never heard from them again.
However, six months ago or so they demolished their one story building and put up a construction fence which prohibited vehicular access. I then called on and explained my predicament to the wife of the owners son (she was the only one home at the time). She said she would talk to her husband - I left my card. A week or two later I was told that the land was now in a Family Trust and that I would have to speak to the person handling the trust and was given the 'phone number. I called immedialtely and was told that I could no longer have access even though I had a year 2000 Ford plus the boat and trailer trapped in my yard.
What recourse do I have?
