My friend (and neighbor) sold her car for $1500.00 cash - told the buyer that the car needed some work and that the front wheel suspension was not safe to drive and the car should be towed. Buyer said her brother is a mechanic and drove the car 45 minutes to her house. She did not want a bill of sale. She also said to my friend not to sign the title. 2 weeks later she came to her house and demanded that she give her $3,000 since the car needed alot more work. She refused to leave my friends premises and threatened her, she called the police. She is now suing my friend in small claims court for $3000.00. She will have to take a day off from work. We would like to know how she was able to sign her name on the NYS sales tax form? Does she have to pay her this money, was under the impression that private sales are as is. The ad placed said as'is. thanks.

She more than likely forged her name.

Private sales are always as-is.

This is a case of she-said, she-said.

Your friend was smart give her the $3,000.

The buyer can sue.

Your friend has nothing to worry about.

She only needs to show up and tell the truth.

The buyer won't win, unless your friend doesn't show up in court!!!!

why should my friend give the buyer back double her money back? $3,000??? I don't think she deserves anything back. WHo knows what she did with the car after she bought it.

I think Army Judge might have mis typed something. I think he meant to say she was smart for NOT giving the buyer the money. I will let him clarify. But otherwise he is correct that it is an as is sale, and unless your friend fails to show up in court, the buyer will loose the case.
