A person may need to go to probate court under certain circumstances but it is certainly not required in all circumstances. For example, if a person dies "intestate" - that is without a valid will - you may need to go to probate court in order to settle the estate. A personal representative is then appointed by the court to handle matters concerning the estate. Without more information I can't provide a better response.
