Probate or Non Probate

My Father passed away, in his will he appointed my sister as executrix.....his will states that his assets be divided equally amongst his 4 children....my sister is being unbearable!!! My question is as follows, My father owned a piece of real estate in which he was 66 2/3% owner and his brother owned 33 1/3%, would this be a probate asset or non probate asset?

Depends on how they owned it.

Get a copy of the deed from the county and quote the ownership word for word.

Don't guess, don't "think" you know, get the deed so you have accurate information on which to base any decision on further action.

If the uncle who owns 1/3 share of the property doesn't want to sell the property, the executrix will have to partition the probate court to partition (court ordered sale) the property, and wait to divide up any profits among the heirs.

You need to accept whatever scraps someone throws you, or hire a lawyer to ensure you get what you're supposed to get.

Imagine what some of those hungry sharks can do to someone living on a different continent, 4,000 miles away.
