probate & stepchildren

My father passed 2002 and my step-mother passed a few yrs before him.My father gave them every right to come in and get what they wanted and all they took was her doll collection and pictures. My father did not leave a will but left my sister the house. One of the stepchildren is contesting but the others have not said a word. The one contesting the probate. Broke in and vandalized the property. He is in the state pen and has someone else living in the house. I am planning on moving in the house in the next couple of months. What I need to know first do I have the right to evict that person, and is can the stepchildren inherit the property, and if my step mother passed first are they still entitled to the property?

I presume "them" is the stepchildren and that your father did this prior to his death, correct?

My father did not leave a will but left my sister the house.

How did he leave the house to your sister? By what instrument was this done?

Who owned the house? Father and stepmother? In joint tenancy?

If there is no will, what are the stepchildren contesting?

If the house was left to your sister, on what basis are you moving in?
