About three and a half months ago I called Bally's to downgrade my membership, which they agreed to do at that time. The downgrade for my husband and I came to about $20 a month. I kept waiting for the downgrade to happen, never did. Two weeks ago I called to complain and was told the paperwork wasn't submitted properly by their representative. At this time they promised to reimburse me the $60 they mistakenly took out of my account. This morning we went to the gym and they told me my husbands membership was cancelled, but that my membership was downgraded. Except I was still paying the 59.26 a month, which is $20 more than I was paying for myself before they "downgraded" my membership. So this time when I called, they told me the paperwork wasn't submitted properly, again. Now we have to get visitor passes to go until they can get this "paperwork" problem taken care of. As of this time they have agreed to the original downgrade and said it would take a week to get the new account set up. I have the names and empoyee ID numbers of everyone I spoke to, along with dates and times for my own records because they had tried to say they had no record of the original conversation. I think that a verbal agreement stands up in court, and that they have broken our agreement. When I asked for a copy of the original contract They told me I had to pay $50. When I asked for an email of this "new" agreement, they told me I would get it in the mail. I am not hopefull. Is this considered a violation of a contract on their part and do I have any legal rights here?
