Problems with Spark Driver

My friend applied to work for Walmart deliveries (Spark Driver) several months ago.
At first, he was on a waitlist. I believe that background check is done right after you apply while on waitlist - it was completed and came back clear. Finally, he was notified that he was taken off the waitlist and needed to submit documents via app. There was a lengthy list of agreements to sign in the process (those that people rarely read). However, when he was prompted to submit his DL / proof of insurance etc, a glitch occurred and his account became deactivated.
He tried to resolve it but their customer service is separate from deactivation department and all they say was to appeal again and again. Which he did several times but the only response he ever received was
"After carefully reviewing your appeal, we decided to keep deactivation in place"
The reason was never stated (there is no reasons to deactivate him, all his docs are in a good standing)
There is no chance to talk to a real person in deactivations.

After asking around, he heard that some other people were going thru the same issues - deactivated before they even started. We looked online and someone on Reddit said that requesting pre-arbitration with Spark worked for him

Given that my friend hasn't even started working for them, I'm not sure if him and Spark have any contract relations that allow to demand arbitration - ? What do you think? Is there anything he should try to have them change the outcome? Thank you.

Your friend has no right to work for them, nor do they have any obligation to hire your friend. Your friend needs to continue to avail himself of the appeal options and also look for some other place to work.
 
To be honest, I don't see that your post raises any legal issue, but I certainly agree with the prior response.

thank you Zigner and this is sad that the company has such a bad practice (people complain all over the internet). Customer service says deactivation department MUST give a reason for deactivation which they failed to provide. My friend will probably try to request pre-arbitration phone call , it won't hurt anyway

I agree it can't hurt, but I can't fathom why you feel that your friend has some sort of right to drive for them.

The company uses shady practices. If they don't hire at this time because they have enough drivers, then they should say just that, instead of making him think its somehow his fault and he did something wrong. Also, this deactivation completely bans him from trying again, in case they didn't need drivers but going to need them in his area in the future. He needs a very flexible job due to family circumstances
 
When one door closes, that doesn't simultaneously close all other doors.

Also, this deactivation completely bans him from trying again, in case they didn't need drivers but going to need them in his area in the future. This is an employee relations matter, not a customer service matter. It's very easy for people to complain on the internet, but you need to understand that satisfied people don't post about being satisfied, so things are skewed.

Ok...but, unless they're discriminating on the basis of race, ethnicity, gender, etc., it's not a legal issue. There's no law that mandates that everyone has to be happy.
