Process to Reply to a "Summons"

... It is issued by a Collection Agency through a lawyer. I need your expertise on the process of responsing to this:

1. I need to get a proof of their accusations. I dont believe we owe that amount of money to them, do we call the collection agency first, or do I include this request to the response to summons (denying their claim)? -OR-

2. Someone suggests that we talk to this Collection Agency and settle, if we become sucessful doing this, are they in obligation to pull-out the case and not go to court? Also, are they clearing the record on the credit report?

Summonses are issued by courts, not collection agencies or lawyers.

So...did you really get a summons or just something that looks like a summons?

If you settle (meaning $$$...they don't want your promise since they already know that is no good) then you do not go to court.
