I have a two year old daughter with my ex boyfriend & he paid a processor to serve pe for visitation court documents.. This processor never served me in person & I was completely unaware of any court dates. I was not trying to dodge or runaway from this matter it was never an issue. I later moved to another state & after months found out through my Ex boyfriend that he won custody by default of me not showing up. I was completely unaware of an hearings & the processor has never seen me or given me documents. My Ex boyfriend purposely didn't inform of the court date hoping he would win by default. How do I prove I wasn't served?

Proving you weren't served is proving a negative.
Most would say proving a negative is impossible.
You know, like when did you stop beating your dog, when was the last time you raped a horse, when did you stop stealing from your employer, extremely difficult; if not impossible.
You can discuss the matter of service with a lawyer.
You can eventually have a hearing on the matter, but its a well known fact that some process servers do lie.
Good luck...

A processor MUST submit documentation that he/she served you in compliance to local laws. If he forged these documents he could be in serious trouble. As instructed you should discuss this with a local Attorney to decide what action needs to be taken
