I've been a new position for 7 months and I've been with this company for 6 years. Recently a rare position opened up at my company and I was asked by the hiring manager to apply to it. I applied and I was told by my current manager that HR has deemed me ineligible for the position because I haven't "mastered" my current position. There is no said policy at my company that says I cannot move positions. I was not supposed to know all this information but I do and I don't think any of this should be allowed. The hiring manager approached me and apologized saying she was not aware of any kind of policy and she was told all this by HR two days after my interview with her. She also said that HR told her they would explain things further but no one has talked to me. I don't feel that any of this is right. I've reached out to other stores within the area to verify that no policy exists and they've verified that one does not. Is there anything I can do? They run the whole show. I'm in fear of retaliation.
 
Even though you feel it is not right, I don't see anything illegal here done by your employer based on what you posted. Not right/unfair doesn't always mean illegal. Even if there is no policy against you moving positions, doesn't mean the employer has to move you. They might have an "unwritten" policy.
 
There doesn't have to be a written policy and they do not owe you a promotion, even if you were invited to apply for it. If they do not feel that you are effective in your current position, no one is doing anything illegal by refusing to move you.
 
I don't know what causes people to believe a job is a right, or why an employer owes an employee any more than the current period payroll check for wages earned?
 
There doesn't have to be a policy, it doesn't have to seem fair to you. Work hard and master your current position and better luck next time.
