I live on the first floor of an apt building in nyc. Back in mid-April I came home to find my closet flooded. All clothes were damaged. Shoes & sneakers destroyed. Nothing else in apt was affected. At the time did not have renters insurance (which is not required by law).
Took clothes to specialized dry cleaners - cost over $725
Sneaker/Shoe loss = a little over $1000
lost a day of work = $300
Had been told by super that landlord would reimburse for all damages caused. It was due to a pipe 2 units up that super knew was faulty. Sent landlord mail (return receipt) with receipts for damages. Sent twice. Landlord initially says theyve referred situation to their insurance co (before they ever received my docs). Since receiving he has been ducking my calls.
Took case to manhattan small claims - was told i cannot pursure small claims in manhattan as the business had moved their offices to a ny county out of jurisdiction. If i want to pursure in manhattan I am to go via regular civil court. Otherwise i have to wiat til end of 09 for small claims court date in thsi outher county
Question is how much do i sue for in civil court. Originally i had only wanted what was due me but now wondering if i should be pushing for more in civil court. not sure what to do here. pursue for amount owed me or push for more?
anyone here know how to handle?
