I am in Indiana. My husband and I were living on the property where he worked for an employee discount. He was fired on November 15. The property manager gave us until November 30 to sign a new one year lease at the higher rate we cannot afford or vacate the apartment. I asked her if we could pay the month to month rate to stay one more month and she declined. I don't have anyplace to go and I don't want to be forced into signing a lease I can't afford. Do I have any recourse? Is there a minimum amount of time that you should give for a tenant to vacate?

It would appear from your posting that your old lease had the clause of the employee discount. Since your husband was terminated, that lease is no longer in effect and the landlord wishes to institute a new one; one that does not have the employee discount.

Once the old lease expires, the tenant has two options; either find another place to rent by the expiration date or sign the new lease. Your landlord has already declined your request to go month to month.
