My wife and I came across a piece of property with a old house for sale by owner.While talking with the gentleman the property belong to his sister who had passed away some 2 years before, we were told his brother had affidavit of headship and would handle the sale. The date this started was February 16, 2014, we started by getting a title company, a local bank for financing, even a surveying company. Time rolled on and it was time to close, with a date set tentative, then it passed. We found out after this all the paper work was not in order, they need a power of attorney to finalize the deal. The problem is all of the property goes to all heirs since there was no will. The women had 8 brothers and sisters with one sister passing away, now her two sons are involved and don't want to sign for the sale to go forward. We are out of monies for surveying of propriety and not sure if title company has any charges. My question is is there any way to handle this sale for us to continue, the siblings are in there 80's and would like to finish the sale. They have talked to a lawyer in a small town and not sure where they stand. Thank you in advance Richard320

Yes, the certificate of heirship, a true Texas special. LOL
I suggest you walk away, cut your losses.
This could get even more expensive, and if only one of those people balks, things stop.
There are other issues that would make me bore you even more.
You should talk with an attorney, if you are bound and determined to push this forward.
It'll cost you more money, but its the only way to handle a legal fiasco that could be brewing.
