I am relinquishing my home through a deed in lieu. The title search came back with a lien on it. I honestly have no idea who the finance company is. According to my mortgage company the loan had been repaid. The problem is the lien was never released. The finance company has gone out of business. The bankruptcy trustee says there's nothing he can do be cause he never had ownership in the company. How do I get a lien released when the company is defunked? I can't procede with my house until it's cleared up

This will require the services of an attorney licensed in Missouri.
You should talk to a couple tomorrow and see what they have to say.
Your initial consultation is normally at no charge.
You'll need to bring suit in the county where the lien was attached.
You'll have to prove the company is bankrupt and has no legal successors or assigns.


I hope you know that what you're trying to accomplish is a questionable strategy.

It makes no economic sense to give back a "deed in lieu" unless the "Acceptance Agreement" stipulates that you, the homeowner, will have no additional obligation for the remaining deficiency!!!!!!!!!

You should not sign any documents from the lender or anyone else without having an attorney review and approve your signing.
