My husband and I were recently evicted from our apartment for non-payment. We had already begun moving into a new apartment, but hadn't yet had a chance to take some last things. When we returned, only about 36 hours after our eviction hearing, we found that several things were missing. Our landlord is the only other person with a key and there was no sign of forced entry. I know that, in the state of NY, the landlord is obligated to store tenants' property even after they have been legally removed, but we were still within the 72-hour period proceeding that. What are my rights and how can I go about getting my property back?

Check NY abandonment laws however, if you were actually EVICTED with the sheriff/marshall moving you out, your belongings may well be in the dump.

It is NEVER a good idea to make several trips when being evicted....you should have moved in one trip so that your belongings were not left unattended.
