Proxy vote by non responce

I live in Roswell Georgia
My subdivision association has sent a letter by regular mail with a form allowing you to vote on an increase in subdivision fees.
This letter also states that if you do not respond that this will mean that your homeowner's association member will use your vote on your behalf. I have a problem with this, as by default you cannot assume that you have my proxy.
I know that I only opened this one out of all the others instead of treating all mail from them as junk mail.
I also thought that it was illegal to assume proxy by non-response.
This is also a farce as the homeowner association is the ones proposing the increase so are feathering their own nest doing this.
 
You should check your bylaws to see what's allowed. As far as I know, it is not illegal for an association to adopt a bylaw stating that the association member will use your vote on your behalf if you do not respond. The Georgia code, to my cursory inspection, is silent on the question of non-response, and provides that associations can adopt bylaws authorizing additional means or procedures for shareholders to exercise rights.
