This is in reference to a US Forest Service road (FR134) in the Santa Fe Nat'l Forest of NM. An private owner of land either adjacent to or that the road passes through has posted Keep Out, Private Property signs, blocking access on a portion of the road. Contact (via email) with the local Forest Service office has revealed that the FS has screwed up in obtaining access easements on several roads in this area, dating back to the 1970's. Our gov tax dollars hard at incompetent work! Apparently lengthy negotiations in the 1970's resulted in the FS gaining access easements on the major road in the area, but they did not pursue rights on some roads they classed as minor.
From the 1970's thru to approx 6 to 8 weeks ago the public had free access on this road from one end to the other. There were no signs posted. Now the landowner has posted the above mentioned signs. The FS has just recently told me they have no intention of pursuing the matter at this time.
My question is, since there was uninterrupted access for so many years is there some NM law that would grant such continued access through the section of FR 134 in question? If so how would the matter be pursued?
