Public Intoxication while riding in a car?

I was pulled over a week ago for making an illegal u-turn. The cop gave my boyfriend a ticket for public intoxication for being the passenger in my car. He was not rude, beligerint, etc. In fact both of us kept our Southern politeness intact at all times - yes sir, no sir, thank you, etc. I know people say it all the time, but I really think this cop had it out for us. It was my birthday, I have a perfect driving record, I was so polite to him, and he still insisted on giving not only me a ticket, but my boyfriend as well...in my opinion for no good reason. I can totally accept the ticket I received, but not a PI for riding in the car.

The jargon I've researched so far states that the person is endangering himself or others, etc. However, I can't find anything that defines "public" anywhere.

Can someone help me out with this one? I can't see this possibly being legit, but who knows...it's Texas.
