Does anyone know of a law that protects an employee that has done something wrong, but was intructed to do so by the supervisor? I know the military offers that protection and would think that would apply in the civilan world. I do have the manager on voice mail telling me to do it and basically threating if i didnt. Thanks.:mad:

You are referring to following a "lawful order".
Military personnel are required only to follow "lawful orders".
You can't claim that defense, if you do something that a superior orders you to do knowing that it otherwise illegal to do.

A superior orders you to rob someone, kill someone, or rape someone.
The defense, "the captain ordered me to do it" won't work in the above scenarios.
You might recall the Nuremberg Trials?
Many German soldiers were convicted by claiming, "I was just following orders by killing 200 Jews."

If a supervisor orders you to say, "We don't serve ******* people here."
Or, a supervisor tells you to "beat the F*CK out of that shoplifter", who later dies.

You can't later use the defense of I was following orders and avoid legal jeopardy or liability.


In other words, no one is immune to legal process by following the UNLAWFUL orders of a superior.

Thanks for the help army judge. Im just irritated with the whole thing. It wasnt illegal, but the state surveyors were pissed with what my administrator instructed me to do. I was the only one punished for doing what myself and 5 others were instructed to do. Just doesnt make sense.
 
Thanks for the help. It wasnt illegal what i did, but the state surveyors were pissed when they discovered that administration was attempting to hide stuff from them. I was the only person out of 6 that was punished for the exact same thing and that bothers me considerably.

I'm sure it would bother you if you feel you were singled out for punishment.

You might want to discus sthis with your HR Managere or a local attorney.

There might be a remedy.

But if all you received was a tongue lashing, it might be better to take the bitter with the sweet.

You still have a job, I hope????
 
I wont know until tomorrow morning. They have had me on suspension for 2 weeks now and not another soul was even disciplined in any manner. The bad thing is, what were they investigating?? The administrator was just trying to cover her own ass after the state discovered what they did and she thought that would remedy the problem. Ive never even had as much as a write up and i told the state that I was being punished for telling them the truth.
