I had someone come out and give me a $25 deposit on a puppy. I did not hear from that person for almost 3 weeks and when I sent them a message to confirm they still wanted the puppy they told me that they have second thoughts and that because of their work schedule or not sure if they were able to take her. I gave her three days to make up her mind because I did not want to place another ad in the paper to sell the puppy if she did not take her the three days past and I never heard anything back from her.another person called the day after the deadline and I was able to sell the puppy to that person at which time I had sent the initial person a text message instructing them to come and pick up their deposit which I would refund to them. she now claims are $25 deposit entitled her to the puppy regardless of communication and she is threatening legal action. I went through the trouble of finding another home for the puppy when this woman did not respond to my deadline and I feel she is unfit to have the dog and I found at a much better home. Can she sue me for the puppy even if i refund her deposit?
 
She can sue you? Only a court can decide if she prevails. But, isn't it worth not going to court, wasting your time for $25?

Your call. Your business. If she sues,don't ignore it, be prepared to answer, or you'll default. Get yourself up to speed on small claims lawsuits in your county and state. You could be a defendant soon. So you know, it's nothing like Judge Judy or Judge Mathis.
 
You had no obligation to hold that puppy for her. If you have given back the $25 there is nothing more to do.
