purchased lights, did not receive, out of business

I purchase lighting at a light store 11/30 and paid in full. I asked them if they could hold the lights until March during my construction, they agreed. The store moved to a new location in December. I called in February about picking up some of the lights. They told me they were either in transit or should ship in a week or 2. I called again, and again more excuses. Finally the owner admitted they forgot to order the lights and they just ordered them when I called. I received some of the lights, I have 2 chandeliers and ceiling fan at about $1600 remaining. They keep telling me they are on back order or they had to change vendors. I called weekly, a week ago I called and the phone kept ringing, I went to the store and a sign on the door said out of business. The note gave the cell phone and email of the owner and he said he would fulfill orders pending. I have emailed and called 2 times each with no response. What can I do? Can he be charged with fraud? He took the money and did not order any lights.

If he were charged with fraud, you still wouldn't get your money back or the lights.

Go ahead, make a police report.

The police will most likely tell you this is a civil matter.

You can sue the store's owner in small claims court.

That is, if, he hasn't filed for bankruptcy.

Nevertheless, sue him and see what happens.

If it were me, I'd chalk it up as a cost of doing business.

Because, even if you win a lawsuit, that still wouldn't get you your money.

You'd then have to somehow figure out a way to enforce your small claims judgment.

I regret that this crook took advantage of you.

Your options are all pretty bleak.
