Hello everyone! I have a problem that I have been dealing with for some time now. I live in Pennsylvania.

I am involved in a misdemeanor case involving theft; something was lost and I took it not knowing who the owner was. The owner of the property got the property back, unharmed. I went to a preliminary hearing and the judge said that he thinks I am guilty, blah blah I didnt expect any less from an ex-cop of this city.

I have talked to several police of different areas and some of them told me to go to the DA and talk to him about my case. Is this a lost cause? I tried to talk to the cop that was prosecuting me, but he doesnt want to talk to me so I dont have anyone to talk to with this matter. Thanks for any advice.

If you live in monroe county your screwed they are the most corupt county around. From the judges to the public defender.

The first thing is cops don't prosecute………..Only DA's or assistants do. Whatever the judge says in the preliminary hearing does not matter. He might just have offered his opinion. So make sure you chose a trial by jury if you go to trial without cutting a plea deal. Did you request a public defender during your first appearance or do you have a lawyer? They are the once to work with the DA for a solution not you. You don't know the law and might even compromise your defense. I don't have all the facts nor evidence to advice you on some possible options. You mentioned the owner got back the item…..That does not matter, what matters is if you gave it only when caught or finally knew who had the item and returned it on your own. If it was not yours, you normally are expected to give it to authorities to find the owner. So the circumstances under which the owner got back his item and declared his loss would determine if you stole or not. That is what will determine your innocence or guilt.
