Question About Moving

I am currently in Ft. Bend County, outside of Houston, attending a local Junior College. I plan on transferring to a 4 year university sometime soon, and my wife will be coming with me. She has 2 kids from a previous marriage, and in their final divorce decree, which became final in Oct 2009, her kids are limited to Ft. Bend county. I know people move away all the time, and I was wondering if and how I can get this changed to allow the kids to come with us.

The 2 colleges I am looking at are Texas A&M University, about 80 miles away from here, and Texas Tech, which is in Lubbock, accross the state.

•Will it be difficult to get this changed to allow her and the kids to come up with me to either College?

•Also, what are my chances of getting this done, should the Ex husband decide to fight it.

•Is it something I can go in front of a judge, and let him know the situation, and allow my wife and kids to follow me up to either one (and if so, how would I do this?)?

•Will A&M be easier to get changed then Texas Tech, because of its location? Or, does it not matter.

First, you can not ask the court to do anything on this matter. You, like myself with my stepdaughter, are a legal stranger. Your wife would have to show why it is in the children's interest to be moved. If it was allowed by the courts, your wife would likely be responsible for all transportation cost. My wife and I moved from Virginia to Ohio almost two years ago. This was allowed because my wife was able to work out an agreement with her ex to get him to agree. Had he fought it, it would have been likely that the courts would have denied the move.
 
Agreed. OP, you won't even have a chance to get in front of the judge.

This will be your wife's task - to prove why the kids should be moved so far from the other parent.
 
Your wife should talk to Dad and see if they can come to an agreement. If they do then that agreement can be brought up to Judge so he can modify order. In meantime do not commit to anything and look for a closer school if possible.
