I'm applying for a job as a sheriffs deputy, and part of the process is a personal history sheet. One of the questions asks if you have ever commited a criminal act and weren't caught. I marked yes and gave the specifics. I am wanting to know if they can use this to prosecute me. The incident took place 8 or 9 months ago. I did not harm a person or anything like that however if I would have been caught it is a felony.

They likely are going to have you take a lie detector test anyways. So the fact you were upfront and honest, it might come back and haunt you. If you got away with a crime that can be a disqualifier. I gave no idea whether or not being truthful is a dealbreaker, you are going to have to ask these questions to the recruiter.

As far as being prosecuted, well I suppose if they can prove what you did and they can get the DA to file charges, that is possible.

Why are you applying to be a police officer if you possibly commited a felony?

You committed a felony 8 or 9 months ago and you are applying for law enforcement???

But, I have had people apply who have had bench warrants, who have been on active probation with two years remaining, and even one who admitted to buying marijuana for a family member just one month earlier!!

Whether they could use your admission to prosecute you depends on whether or not they can corroborate the statement. Without corroboration, your admission is pretty much meaningless.

Although, consider your possible career in law enforcement as dead on arrival. It just AIN'T gonna happen unless the agency you eventually apply to is completely remiss in their background responsibilities.
