Alcohol & Drugs: MIP, MIC, Intoxication Question about pot

My friend, in washington state, was given a pot brownie, they did not want it, so they gave it to a family member, who shared it with some friends.

one of the friends was allergic to the pot, paid a visit to the ER and the police are involved... :no:

There is No weed in (the person that gave it to a family member's) system, or at their home... there were no witnesses that they gave it to a family member.

Could this person face criminal charges? If this person denied this could they still be in trouble?

This person Will not give up who gave them the brownie, what is the best thing to do? the police have not contacted them yet....

It not illegal to have weed in your system. But it is illegal to buy sell trade or grow weed, however there must be some proof for the DA to charge you.
