Shoplifting, Larceny, Robbery, Theft question about theft...HELP PLEASE!

My husband was working in a convient store and the manager decided to watch him on tape, it showed my husband taking some lottery tickets, which yes he did, but only about 50 bucks worth- only! well, the manger said the register was like 900 bucks short- BIG LIE! so the cops came out, reviewed the tape, handcuffed my hubby, but let him go & just gave him a citation, they said it is only a misdemner(sp) because the tape only showed lottery tickets & the amount was undisclosed, he goes to court on Monday the 6th- he is scared, so am i, but he don't even have a layer yet, so will they apoint him one??? will he get jail time????? ALL he took was tickets...NO MONEY!!!! I believe he is being set up by his store.

i was in the same situation. I was charged with a 1,000 dollar fine. i am awaiting my court date in august. Please mail back if u get a respose.

Im not sure if that would be charge as a theft or embezzlement....anyone have any ideas? Are the penalities the same if the amount is the same only it's a THEFT or EMBEZZLEMENT?

Depends on what state you live in.

Most states though rate embezzelment much more severely than someone from the outside stealing.

What has happened over the past few months, please update.
