Hello and thank you for taking the time to read this. My mother recently passed away and named her boyfriend as executor of the will. Both my wife and I did not have a problem with this, at first and we still don't, even though my wife has been the one to insure that all of my moms final bills and debts are paid and he hasn't done anything.
In the will it states that my moms boyfriend is to get a watch and 100% my moms house, the residence. The remainder of her estate is to go to myself and my wife. Before my mom passed, her boyfriend took $14000, that was left to her from my dad when he passed, and he put it into one of his bank accounts. He also took another $1000 from one of my moms bank accounts and put it into one of his bank accounts. After she passed, he took my mom's car and placed it at his place of business and is attempting to put a lien on the vehicle to try and get the title to it, and he has taken another $909 out of my moms savings account. When we asked him about this, he stated that all the money and the car and the house was his according to the will. When we told him that is not what the will says, he says that we should have read the will better. Unbeknown to him is that we have a copy of the will right here. We have tried to inform him that all he gets is the house and the watch and we are to receive the rest, but he will not listen to it. We told him then that we would like to have the attorney who drew up the will on behalf of my mom, to read the will to us. And he doesn't want to do that, stating that it is an unnecessary expense. My wife and I haven't touched any money in any accounts, because we were waiting for him to pay her final bills, which by the way come to at most $400. He has stated that he paid the bills.
My question is this, what can we do now? He is literally stealing all of her valued belongings and our inheritance. We have access to the bank accounts which contain the remainder of her money, but we don't want him to have anything that is not his (such as the remainder of our dads money) and should be ours. Can we withdraw the money to safeguard it? Can we call the police and report the money and vehicle as stolen? We are at our wits end, because on top of losing our mom, who wanted to make the will as simple as possible so there could be no misunderstanding of it and who was loving and always willing to help people, he is giving us an emotional strain that is putting us at our very end.
Please help if you can, we need to have some direction to go in.
