I am trying to get custody of my child back from my ex spouse. After speaking to an attorney, she told me that I need more concrete evidence. My 20 page supporting document was not enough. Besides info from a child therapist, the child's preference, family ties, drug, alcohol, and physical abuse, what are examples of concrete evidence that helps change custody. If there are any, how do would present/gather it?

Thank you.

You've discovered the major ones, most of which are treated as minor.

To wrest custody away requires a very egregious wrong or harm, most of what you've cited are considered minor.

Sorry, your attorney's advice is correct.

That's why it's called a change in circumstances.

A major example, that would cause that immediate change would be if the parent left a child alone for three or four days, allowed others to use the child for sexual pleasure, or refused to take the child for medical care for a broken bone; but even those aren't always 100% winners.

Work with your lawyer and keep your eyes peeled.

info from a child therapist, the child's preference, family ties, drug, alcohol, and physical abuse,

Did any of that result in Child Protective Services intervening? In not, than it could have been 100 pages and got you nowhere.

what are examples of concrete evidence that helps change custody.

Getting Child Protective Services involved to the extent where they take the child away from the harmful environment.

Until then, you've probably got nothing.
