Alcohol & Drugs: MIP, MIC, Intoxication question on MIP

im 19 and a few weeks ago a cop saw me with a drink in my hand on the beach. i did not even take a sip and i was holding it for my friend that is 21. he gave me a MIP. This is my first ticket ever and i want to know if i should ask for deferred or plead not guilty. it does not seem fair
