I have lived with my boyfriend for the past 7 years not leagally married. we have a beautiful daughter together, and now he is talking about how he is glad he never married me. I have been off work for the last year due to a lay-off and unable to find work. now he is talking about taking everything from me. The thing is we have a checking account together, a car title together, everything we own in the house we bought together. We have considered ourselves husband and wife for 7 years, but I have never used his last name as mine. We were waiting on the right time to get married, but I suppose he is right and its good we never did. My question is what do we do with all the propertie, (we don't own the house). Plus what about our daughter whom we both love very much. Is there a way to distribute it without a lawyer. I don't have any family or friends here... he does... I moved 1300 miles away for him, and now I'm stuck... what do I do?
 
Co-titled assets belong to both of you. Work out a distribution. It sounds like more importantly, you will need to go to court to establish a custody/child support/visitation order.
 
He has no custody rights, insofar as the child is concerned unless and until he goes to court. He will also have to establish paternity to prove he's the father. He can acknowledge paternity, as another way to accept responsibility for his portion of the child's support. The good news is, and Yiu shouldn't tell him, is the Attorney General of Texas has a child support office to help you establish support.

As far as the other stuff, if your name is on the checking account, theoretically you are free to clean it out. So is he.
The car is another matter. That might require a compromise, or a trip to court, if Yiu can't agree.
