I am in Virgina. My daughter was in a single car accident. She was sitting at a light. When the light turn green, she proceeded to make a left turn. She said the tires started to slide and to avoid hitting another car, she tried to regain control and turned right jumping the curb, hitting a utility pole and landed in some someones driveway. She fine with no injuries. But we called the police to report; because I thought this is what you were supposed to do and he gave her a ticket stating reckless driving too fast for conditions accident; A.46.2-861. It was pouring down raining. My daughter said she wasn't speeding. Actually, the accident occured only about 25 feet from the corner where she turned. She could not have gain enough speed to be speeding. We know my daughter. We call her slow poke when driving. That's why she stays in the right lane. I read over the court cases for reckless driving and most of them are dismissed. I can't figure out how the officer can give her a reckless driving ticket without him witnessing the accident. Can anyone give me an idea of what her chances are beating this. We never had an accident in this family so we don't know what the court system usually does in these cases. She received a letter from a lawyer wanting to represent her. Where did he get her name? Do we need a lawyer for this kind of ticket?

Tickets are public and attorneys get the information from the police department. I am always wary of them but some excellent attorneys in VA do this. Check out his references first.

You and your daughter could go in and talk to the prosecutor to see if you can work out a deal prior to your court date. RD is six points, she will probably be dropped off your insurance and you will have to pay 1050 to the DMV on top of the court fine. You might be able to negotiate for a 3 point improper driving ticket. There will be an insurance increase just because of the accident so you need to mitigate it as much as possible.

RD is a serious offense and letting an attorney negotiate for you is always a wise choice. He may be able to get a dismissal with court costs.

She would not have had the accident if she were driving properly, so the chances of beating it are zero.

As lwpat said, get a lawyer.
