Hello all, Railroad detectives went to my 14 year old daughters school and questioned her about our adult neighbor taking a old railroad tide. Reason is because they came to my home first and asked if I knew of him doing it because one of our other neighbors said that he had bragged about it to them and my family at a cookout. I told them nothing and to get lost. Well while questioning my neighbors they gave the detectives the name and school of my oldest daughter and that she was there and overheard this. So after they left my home they went to her school and had her brought to the office and questioned her about this. She is 14 and was scared so she said she heard him say it. From what I have read they were allowed to question her without her mothers or my permission since she was not the one the case is pretaining to. Is that correct? also from what I have read they cant actually use what she said against my neighbor in court. Is that also correct? My neighbor is a good guy who MAY or MAY NOT have done a stupid thing (lol) We just dont want to be any help to them with their case. Thanks.

Thanks mighty. If he is charged and my daughter is called to testify then she will tell the truth. Again thanks.

If properly done, a 14 year old can be compelled to testify in a case that does not involve the minor.
You, as her parent, have the right to resist her being compelled to testify in a legal proceeding.
However, as the child was not under oath when she spoke, and because she was scared, a case can be made that she said what the officers wanted to hear. You might wish to speak with your neighbor's attorney for guidance, as your daughter seems to be a key witness in this nothing case.
