random non d o t drug testing

The trucking company I work for has a corporate office in Oak Brook Il. We have aproximately 50 terminals. We supposedly have a company wide random drug testing policy for all employees including both DOT ( FMCSA required ) and non DOT personel but terminals in some states do not have random testing for non DOT personel. Is thid legal ?

Yes. Some states do not permit random testing for non-DOT personnel. It is never illegal to waive a requirement for employees in states that do not permit it. They are not required to waive it for employees in states that do permit it just because some employees are exempted by state law.

It is a myth that what happens for one employee must happen for all.
