Assault & Battery Raped & needing help

New Jersey, 2002, I was 16 & raped. Now that I am older, I am getting a better handle on things & am ready to deal with what happened. I sought counselling when my husband & I moved across the country to Arizona. I just relocated with my husband to Kansas, due to my husband's job, & am also unsure what the law is here. I am continuing counselling, but I don't know the statute of limitations. The law is different according to state (which I think is rediculous, personally) but would like to know what my options are as far as reporting it or documenting it. Also, I was recently informed that this individual is currently enlisted in the NAVY. I am unaware of military protocol for something of this nature. *As I was a minor, I don't know if the statute of limitations would qualify. I am honestly just confused & overwhemled with this entire thing. Any helpful advice is appreciated.

I'm sorry you had to endure this agony OP.
I'm happy you're getting help.

In NJ, you can still bring your allegations.

You start in NJ, where this beast attacked you.

Don't worry where this creature is now.

You report this, they'll find this savage.

Being in the Navy will make it easier.

Report this crime to the police agency in the jurisdiction where you were violated.

Here is the law:

New Jersey
Civil Statute of Limitations
Discovery Rule : 2 Years. "In any civil action for injury or illness based on sexual abuse, the cause of action shall accrue at the time of reasonable discovery of the injury and its causal relationship to the act of sexual abuse. Any such action shall be brought within two years after reasonable discovery".
Delayed Tolling : A court is also entitled to toll the statute on other grounds including "the plaintiff's mental state, duress by the defendant, or any other equitable grounds."
Criminal Statute of Limitations
No SOL for sexual assaults; 5 years for other sexual crimes : Prosecutions for sexual assault and aggravated sexual assault may be commenced at any time. These offenses cover victims less than 13 years old, as well as victims between 13 and 18 if the abuser is either a relative, has supervisory powers over the victim, or stands in loco parentis. All other sexual crimes carry 5 year SOL periods.
Delayed SOL and Discovery Rule for Sexual Contact and Child Endangerment : Prosecutions for criminal sexual contact, and endangering welfare of children, may be brought within 5 years after the victim reaches age 18, or within two years following the reasonable discovery of the offense by the victim, whichever is later.

Starting in Jersey would be great, but it's just not an option. We simply just don't have the money. Is there anyway that I can do anything in Kansas where I am now?

Make a phone call to the police or sheriff department where the rape occurred in NJ. They will then work with the detectives in KS to get your statement to begin the investigation of your case. You can do this from KS, but you have to begin by reporting it to the NJ jurisdiction where the rape occurred.

Good luck and I'm glad you are feeling confident enough to prosecute now. It will be a long, hard road. There is a good book out there in case you haven't already heard about it. It is called "The Courage to Heal". It is truly a great book for body & soul.

The crime occurred in New Jersey.

New Jersey law is prevailing in this matter.

If you want this bum to get his day in court, you must file your complaint in New Jersey.

You can start with a telephone call to the police agency in the city or township where this happened.

You can also call the county prosecutor where the assault took place.

If it was Bergen County call the Bergen County Prosecutor's Office, for example.

Here is The BCPO web page:

http://www.bcpo.net/

You can Google the county in question, and get they contact details for that particular county.

Tell them your story.

You can also write them a letter.

They'll investigate and eventually they'll fly you out there for the formalities.
