My daughter was attending college in north carolina and sign an one year renewal agreement for a year, however she lost her job and needed to come back home (June 2008 and she was never late one anypayment) prior to the new lease starting (August 2008 - July 2009). She contacted the leasing company to inform them and she also told them that she had someone who was willing to take over the lease. She notified them when she was moving and returned the keys. However a week before the new lease was to begin they informed her that the person did not past the screening process (which they began in June). Shes been calling every month to see if they have found an replacement. Now they want to evict her. if she is evicted will she be responsible to pay the lease in full as well as court cost even though she return the keys and notified them as well as trying to find someone to take over the lease?
 
An eviction is seen as the landlord "breaking" the lease. Thus, if a judgement for eviction is received from the court, the lease is now considered terminated and the tenant does not owe any further rent.

An eviction is used to end a lease with a tenant (and, in many cases, actually move them out of the unit) and to get possession of the unit back in the hands of the landlord. It is not a judgement for owed back rent.

For that, the landlord would need to refile (usually in Small Claims Court as most of the time these amounts are within the guidelines allowed by a particular state) as this time around they are asking for a monetary award.
