A friend of mine... called the police (their non-emergency number) during normal business hours and recorded the call without stating that the call was being recorded. The investigator said some things that would be very useful to the defense in a criminal trial. Is the recording of the conversation an illegal act? If so, is there a statute of limitations for it?

I (and my friend) thank you for any help!

Dave

Depending on the laws in your un-named state, the recordin may have been a criminal act.

You should check with an attorney, but it appears IL is a two party state. However, at least one reference indicates that not all such recordings are automatically inadmissible and that an 'in camera' hearing is generally necessary before any such recordings can be admitted.

Consult local counsel before you consider using such a tape that might land you in jail.

Carl,

Thank you for your response. I have asked this question of at least two lawyers and didn't get an answer. I was hoping someone here could answer.
