Hello,
I received a small claims judgment in Austin, TX. The defendant owns properties in Utah. Will I be able to record the TX judgment with the county clerk in Utah and either get paid if he tries to sell or hire an attorney to attempt to force a sale?

I recorded the abstract of judgment in Austin. The defendant owns his primary residence in Austin, but it is protected under the homestead laws. He had an investment property in Austin, but I believe he foreclosed on it recently.

thanks in advance for any guidance.

Scott

I dont know all the circumstances. In general you can perfect your judgment in the foreign state. However, if it is via default, the defendant can choose to fight it and claim that the jurisdiction was improper in Texas. You had better be prepared for that argument.
