Before I obtain a divorce, I need to get an order from the judge to get receipts from a doctor on my husband. It has his mental diagnosis. No one believes me with out the codes on the receipts because he convinces everyone that I'm the one whose crazy. What forms do I need?

I am wondering if you have a divorce lawyer representing you in this proceeding. Do you have any idea what the diagnosis is from your husband's psychologist? You're assuming that it will help you. I'm not sure what you're trying to accomplish at this point in order to file for divorce. You can make an allegation within your petition for divorce and don't need to prove anything at this early stage. Statutory grounds for a fault divorce (no-fault divorce is available in Texas) are:

  • adultery
  • cruel treatment
  • abandonment (at least one year)
  • incarceration (greater than one year)
  • confinement to a mental hospital for a minimum of 3 years
  • living apart for 3 or more years

So you may want to file for divorce but not deal with the issue of proof until later in the divorce proceedings. Good luck to you.
