Recourse employer has?

Hi,

i have been with my current employer since mid 2011. My year end 2011 and 2012 ratings were average(meeting expectations). I got a new manager in late q3 2013 and the person gave me 2013 rating as "not fully meetings expectations". The written review did not capture the entire year. This rating was delivered to me in feb and was at odds with the feedback i was getting through the year. Now my manager tells me that they want to give me pip.
Please advise what recourse does my employer have if i refuse to sign the pip since i know the outcome is forgone and i dont even agree that i am subpar.

Doing a quick scan regarding PIPs tells me that you can't win here no matter what you do.

If you agree, they've got a decent cover-their-backside if you get fired.

If you don't agree, they can fire you anyway.

What I don't think you should do is leave voluntarily.

I'm also operating under the premise that you are not a Union member and you don't have any other CBA.

The question is not what recourse your employer has. If you refuse to sign the PIP his recourse is to fire you. And it's not a foregone conclusion that you'd get unemployment.

The question is, what recourse do you have if he fires you for refusing to sign. And the answer is, your recourse is to file for unemployment, hope you get it, and look for a new job.
 
Just do not quit unless you have another job - if you get fired, your chances of getting unemployment ins. are much better than if you quit though no way guaranteed.

I hope things work out for you.
You do have one more choice, start looking for new employment.
Even if you get UI, and you're not able to retire, you'll need gainful employment.
Don't worry about getting fired, most people have been fired once in their life.
Just use this moment as an opportunity to improve yourself.
Nothing shuts up your critics more than your success.
Go make a difference in your life.
Heck, if you want to, sign the PIP and work your tail off and get off the PIP.
When they rate you the next time, it'll be ALWAYS EXCEEDS EXPECTATIONS!!!!
