I am a class CDL truck driver. Recently I was stopped by a NC state tropper for running a red light.He told me that if I would appear in court that the courts usually tried to help out CDL drivers,especially if I did not have any tickets in the last three years and I do not. When I go to court (without an attorney), should my plea be prayer for judgement and if it is denied can I then retain an attorney.

CDL ticket in NC

North Carolina CDL drivers are not supposed to be eligible for a prayer for judgment. The law was changed in the later part of 2004. Now every ticket, even those in your personal vehcile, count against your CDL. There is also a list of serious CDL violations that can result in a suspension of your license regardless of the point situation. I woud go in and talk to the ADA prior to your court date and see if you can work out something like a defective equipment violation. If not you may want to consider retaining an attorney.
