Refinancing to get my ex off the mortgage/deed.

Hello,

I went through a divorce in August of 08 and as part of the divorce agreement my ex was to stay in our home (both our names are on the mortgage/deed) and I would be paying the mortgage until the house sells. If I try to refinance the house in just my name to get her name off the mortgage/deed, is there anything she can do to stop me?

The divorce agreement says that she will remain in the home until it sells. Would she be able to fight me since technically the house is not being sold?

Any input would be appreciated.

She has to sign a quit claim deed for this to be done. You can ask if she will sign it but then she signs away all rights to the house. I would not count on getting her to do this unless you still agree to pay her for part of the house when it sells.
