I had a buyer who purchased a bulldog from my kennel who stated the dog was sick after they took him into the vet five days later to be neutered. My contract states we only cover life threatening conditions. Our contract simply states if the dog sold is found to have a life threatening conditions by a licensed vet they will receive a replacement puppy. They must first send us a copy of their vets report stating the dog has a life threatening condition, once we receive the report we would forward it to our vet to review and may require our vet to examine the dog as well. After reviewing the other vets report and a vet visit, our vets could not determine a life threatening condition, but although, they couldn't find a life threatening condition we decided it was in the best interest of the dog to take him back in and offer them a replacement puppy. However, we have decided we would rather give them their money back but I have a feeling it won't end there and they will possibly try to sue us for the vet bill they incurred before calling us. If they cash the check we send them does this mean they accept the terms of the refund and we're done or can we expect a law suit down the road for vet bills incurred.
