I've recently had a computer from Dell stop working. I called Dell who agreed it was a bad power supply unit and/or motherboard. My warranty includes on site hardware repair, and hasn't reached the expiration date yet. The company, Qualxserv is 1.5 hour drive from where I live. The parts were shipped overnight Monday to the technician who was suppose to perform the repair. After receiving automated calls for four days that they will not show up that day, but will the next day, I called Dell. They stated the parts were at DHL who is on the way to pick up the parts. The next day the technician calls to say he has to take his son to a dentist appointment and wants to play golf in the afternoon so he will show up sometime next week. So far I've missed five days of work waiting for them to do the service which was suppose to be next day service. The warranty also includes weekend work, which the technician ignored.
After this I was quit angry for their lack of service and demanded I talk to a manager at Qualxserv. They refused to put me in contact with anyone other than the person who answered the phones for the company. I called Dell who stated Qualxserv is refusing to do any warranty work for me. I've tried to cancel the warranty, which they refuse. They also refused a refund even though they refuse to perform the warranty.
Is there anything that can be done? I realize that the amount isn't that much, but for a company to comepletely refuse to perform what they are paid to perform is ridiculous. Also knowing that I'm stuck with this company for the remaineder of the warranty is not very comforting.

Let me ask you this - while you want to go the way of a suit, might it not be easier to just ask whether you can ship the laptop to their offices or directly to Dell since the local provider is not providing service? I'm not saying you're wrong, but I'm thinking of solving the problem in the most time and cost effective manner.

Dell is shipping the parts to me. After talking to them again they agreed to do this and void my warranty. Its either that or wait for unknown amount of time for the person to show up. I'm able to repair the computer with no problem. But that's not the issue its the onsite warranty that was purchased and ignored by the subcontractor Qualxserv. They still refuse to refund the warranty, even though it will be voided once the parts arrive.

Then your remedy will be to take them to small claims court to recover the payment for the warranty that never was...
