I have already filed a registration application to the Trademark Office for a dead trademark that I wish to revive. I have done the searches and it is now dead and I have paid the fee and received the application control number (not the registered number). My question is that I have now initiated the process do I have to wait (maybe a year) before I really use the trademark in commerce or will that enable the previous owner to legally challenge the process. I have started using the trademark on the web and in selling goods but I fear expanding it before I get the official registration that the previous owner can back on me or if the fact it is dead and I have already submitted the application gives me 'first in line' rights by virtue of the filing date and a record already established.
