My mother passed away in June of 07.The estate was opened in Sept. of 07.The will was probated,my sister(the only other heir) was named executor. The will favors me,and in an attempt to be fair with my sister, family settlement agreements superseeding the will have been offered. My sister simply demands a 50/50 settlement,in her words"I don't want land,I want MONEY.Can you not get a loan?"She has been slow to try and close the estate. The house(willed to me) is rapidly deterioating. There is a second tract of land that the will states should be sold and the money split between us.There were roughly a dozen antiques stipulated in the will,my sister has taken her share of those already.Does taking her share of the antiques stipulated in the will bind her to the rest of the terms of the will?I have taken over the utility bills for the house after receiving cut off notices, the same applies to the homeowner's insurance policy, paid it up after finding out it had been allowed to lapse.I am weary of paying bills for a house not yet deeded to me.Can I sue to force sale of the second tract of land? How do I motivate my sister to close the estate? She has attempted to sabotage the house,I had the locks changed on the advice of my attorney.BOTH of our attorneys reside in the same small town,I fear collusion between them,as opposed to objective representation.Help, please,if you can.BTW,this has occured in Iredell county,North Carolina.

Quit trying to be "fair". Your sister will not appreciate it anyway. Have your attorney file to have her removed as executor and give him a time limit to have it done by. Submit the bills as a claim against the estate.
